These Terms of Service ("Terms") govern your access to and use of the website and services of ATZ Enterprises ("ATZ", "we", "us", "our"), a registered partnership firm at 425/A, Gala 10, Raut Industrial Estate, Mahim West, Mumbai — 400 016, Maharashtra, India, including all content, storefronts and communications operated under our registered brands Something Else and The Singularity Project (together, the "Services").
By accessing or using the Services you agree to be bound by these Terms and by our Privacy Policy, Cookie Policy, Shipping & Returns Policy and Trademark & IP Notice, each of which is incorporated into these Terms by reference. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years of age, or use the Services under the supervision of a parent or legal guardian, to place orders or submit information through the Services. By using the Services you represent that the information you provide is accurate and that you are legally capable of entering into a binding contract under the Indian Contract Act, 1872.
2. Permitted use
You agree to use the Services only for lawful purposes. You must not:
- impersonate ATZ, its partners, its brands or any other person, or misrepresent an affiliation with us;
- use our brand names, logos or product imagery to sell, advertise or endorse goods or services without our prior written consent;
- scrape, harvest, or systematically extract content or data from the Services;
- introduce malware, attempt to gain unauthorised access, probe or test the vulnerability of our systems, or interfere with the operation of the Services;
- submit false orders, fraudulent payment information or abusive return claims; or
- use the Services in a way that violates any applicable law or regulation.
We may suspend or refuse service, cancel orders and take legal action against any person engaged in the conduct above, at our sole discretion and without prior warning.
3. Intellectual property
All content on the Services — text, graphics, logos, product designs, book content, images, audio, video and software — is owned by or licensed to ATZ Enterprises and is protected by Indian and international copyright, trademark and other intellectual-property laws. Something Else and The Singularity Project are registered trademarks of ATZ Enterprises (see the Trademark & IP Notice for registration details). Nothing in these Terms grants you any licence or right to use our trademarks or content except as needed to browse the Services for personal, non-commercial use.
4. Products, pricing and orders
- Product descriptions, images and prices are provided in good faith and may be corrected or updated at any time. Obvious errors (including pricing errors) do not bind us.
- Placing an order constitutes an offer to purchase; a contract is formed only when we confirm dispatch. We may decline or cancel an order at our discretion — including where fraud is suspected — with a full refund of any amount paid.
- Purchases made through third-party marketplaces are also subject to the marketplace's own terms; where they conflict with ours regarding the transaction, the marketplace's terms govern that transaction.
- Payment is handled by regulated third-party payment providers. We never ask for your card PIN, OTP, or banking passwords — treat any such request as fraud and report it to us.
5. Manuscripts, pitches and other submissions
If you send us manuscripts, artwork, proposals or ideas ("Submissions"), you confirm you own or control the rights in them. Submissions do not create any obligation on us to review, return, or respond, and no confidential or fiduciary relationship arises from a Submission alone. Rights in any Submission we choose to publish will be dealt with under a separate written agreement before publication. We do not use unsolicited Submissions without such an agreement.
6. Disclaimers
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, in relation to the website itself. Nothing in these Terms limits your statutory rights as a consumer under the Consumer Protection Act, 2019, which apply to products you purchase from us.
7. Limitation of liability
To the fullest extent permitted by applicable law, ATZ Enterprises and its partners shall not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising out of or relating to your use of the Services. Our total aggregate liability for any claim relating to a purchase shall not exceed the amount you paid for the product giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under Indian law.
8. Indemnity
You agree to indemnify and hold harmless ATZ Enterprises and its partners from claims, damages and costs (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services, or your infringement of any third party's rights.
9. Suspension and termination
We may suspend or terminate access to the Services, in whole or in part, at any time and without prior notice, where we reasonably believe these Terms have been breached, where required by law, or to protect the Services, the firm or its customers from fraud or abuse.
10. Changes to these Terms and to the Services
We reserve the right to amend, update, replace or remove any part of these Terms — and any other policy published on this site — at any time, at our sole discretion, and without prior notice. Changes take effect immediately upon posting, and the "Last updated" date will be revised. This is a standard protection that allows us to act immediately against fraudulent attacks, impersonation, counterfeit activity and changes in law, without a notice period that bad actors could exploit. It is your responsibility to review this page periodically; continued use of the Services after changes are posted constitutes acceptance of the revised Terms. We may likewise modify, suspend or discontinue any part of the Services at any time.
11. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to any mandatory consumer-protection provisions to the contrary, the courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Services.
12. General
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the policies incorporated by reference, are the entire agreement between you and ATZ Enterprises regarding the Services.
